Changes in the regulation of legal consultants' activities

Law “On Advocacy and Legal Assistance” No. 176-VI dated July 5, 2018 (hereinafter referred to as “Law") was developed and adopted within the framework of the “Concept of legal policy of the Republic of Kazakhstan for the period from 2010 to 2020” approved by the head of state.

According to the accompanying documents attached to the draft Law, the purpose of its development is to comprehensively improve the system of advocacy and the provision of legal assistance. In addition, the authors of the Law consider one of the reasons for its development and adoption to be the fact that at the moment in Kazakhstan there is no comprehensive legal regulation of the provision of legal assistance.

The authors of the Law also emphasize that the field of legal assistance in Kazakhstan is represented by diverse groups of participants with varying degrees and conditions of regulation of their activities. However, uniform minimum standards for the quality of provision and content of legal assistance have not been defined. There is no system for analyzing the dynamics and problems of development in the sphere of providing legal assistance, as well as the general level of quality of providing such assistance. In turn, the professional community of lawyers is developing in a fragmented and unsystematic manner, which, in their opinion, affects the quality of legal assistance.

For his part, being one of the participants in the sphere of providing legal assistance, the author of this article proposes to study section 4 of the Law, dedicated to the provision of legal assistance by legal consultants.
