Draft regulatory acts in the field of foreign economic activity have been published

On the Open Legal Entities portal, draft regulations are posted for discussion that may change current practices in the field of customs clearance and control over the movement of goods from Kazakhstan to other EAEU states.

Changes in rates of customs duties for customs declaration and customs escort

According to the published draft resolution of the Government of the Republic of Kazakhstan “On amendments to the Decree of the Government of the Republic of Kazakhstan dated April 5, 2018 No. 171 “On approval of customs duty rates by state revenue authorities”, the possibility of transferring customs duty rates from a fixed amount to a monthly calculation indicator (hereinafter referred to as the “MCI”) is being considered.

Additionally, the resolution provides for details of cases of charging customs duty rates for customs clearance in a simplified manner. These changes will make it possible to apply a zero customs duty rate on goods processed under a simplified procedure.

After the changes made, the customs duty rate for customs declaration will be:

  • 6 MCI - for goods registered using a goods declaration and using a list;
  • 0 MCI - for goods registered using an application, declaration for express cargo, as well as EAEU goods declared using the list and placed in the territories of the FEZ.

New functions of the Ministry of Finance related to control over the movement of goods

According to the draft resolution “On introducing amendments and additions to the Decree of the Government of the Republic of Kazakhstan dated April 24, 2008 No. 387 “On some issues of the Ministry of Finance of the Republic of Kazakhstan”, the list of functions of the government body has been significantly expanded in connection with the need to introduce control over the movement of goods within the EAEU.

In particular, after the adoption of this regulatory act, the Ministry of Finance will be able to:

  • develop rules for checking documents and information, conducting inspection or examination of goods when moving them across the state border;
  • stop vehicles at checkpoints across the state border for inspection or inspection;
  • exercise control over the movement of specific goods transported across the state border.
