The application of judicial precedent in Kazakhstan is just around the corner: a review of changes proposed by the Supreme Court of the Republic of Kazakhstan to civil procedural legislation
The Supreme Court of the Republic of Kazakhstan (“RK”) has taken a number of positive initiatives to reform judicial proceedings in Kazakhstan.
As part of the implementation of one of these initiatives, the draft Law of the Republic of Kazakhstan “On introducing amendments and additions to some legislative acts of the Republic of Kazakhstan on the implementation of modern formats for the work of courts, reducing unnecessary judicial procedures and costs” was published.
We have reviewed the draft and, in our opinion, most of the proposed changes will undoubtedly improve the quality of justice. However, some proposals require more detailed study and evaluation.
In this regard, in this article the author intends to analyze the most significant of the proposed changes and express an opinion on some of them that require special attention.
