The customs authorities of Uzbekistan will make preliminary decisions on the payment of customs duties

In accordance with the Presidential Decree “On simplifying customs procedures and further improving the organizational structure of the State customs service bodies” No.УП-6310 dated September 10, 2021 (the “Decree No.УП-6310”), a Draft Regulation of the State Customs Committee “On the adoption by the customs authorities of a preliminary decision to determine the amount of customs payments payable in relation to goods imported into the Republic of Uzbekistan” (the “Draft”).

According to the Draft, if necessary, business entities can receive a preliminary decision on the payment of customs duties. To do this, the business entity should submit an application in an approved form with the necessary documents in writing or electronically to the customs authority that undertakes customs clearance prior to the submission of the cargo customs declaration.

A preliminary decision will be made no later than 15 (fifteen) calendar days from the date of registration of the application with the customs authority, and if necessary, additional consideration will be made within 30 (thirty) calendar days. The application will be added into the register of preliminary decisions of the customs authorities.

The customs fee for making a preliminary decision will be calculated based on the rates approved by the Cabinet of Ministers of the Republic of Uzbekistan.

According to the Draft, the preliminary decision will be posted by the customs authority in the unified automated information system of the State Customs Committee, and will be valid for 90 (ninety) calendar days.

In addition, an administrative regulation on the provision of an interactive service on the adoption of a preliminary decision by the customs authorities has been drafted to determine the amount of customs payments payable in relation to goods imported into the Republic of Uzbekistan.
