Presidential Decree on Martial Law

On September 27, 2020, the Armed Forces of the Republic of Armenia started again to violate the norms of international law by using various types of weapons, including heavy artillery, fired on the settlements and military positions of the Republic of Azerbaijan from several directions resulting in civilian and military casualties.

Given that the Azerbaijani Army has launched counter-offensive operations to prevent these attacks, on September 27, 2020, the President of the Republic of Azerbaijan has declared martial law on the whole territory of the Republic of Azerbaijan starting from 00:00 September 28, 2020, based on paragraph 29 of Article 109 and Article 111 of the Constitution of the Republic of Azerbaijan.

According to the Decree, curfew will be applied in Baku, Ganja, Sumgayit, Yevlakh, Mingachevir, Naftalan cities and Absheron, Jabrayil, Fuzuli, Agjabadi, Beylagan, Agdam, Barda, Tartar, Goranboy, Goygol, Dashkasan, Gadabay, Tovuz, Shamkir, Gazakh and Agstafa regions from 21:00 to 06:00 for the period of martial law. The following restrictions will be applied in the territories where curfew has been introduced:

(i)     persons will be prohibited from being on the streets and in other public places without special permits and identity documents. As per the Decision #358 of the Cabinet of Ministers of the Republic of Azerbaijan dated September 28, 2020, employees of state bodies (institutions), list of which is determined by this decision, having service card, or having special permission obtained through registration on the “icaze.e-gov.az” portal, or persons working in fields activity of which is allowed by this decision will be considered as having special permits.

(ii)    special entry-exit regime will be applied, measures to restrict the movement of vehicles will be taken.

Measures envisaging partial and temporary restriction of the rights and legitimate interests of departments, enterprises, and organizations during martial law regardless of their ownership and organizational-legal status, as well as the rights and freedoms of citizens, shall be applied within the limits of the situation and in accordance with the Constitution of the Republic of Azerbaijan, international conventions to which the Republic of Azerbaijan is a signatory and laws of the Republic of Azerbaijan.
