GRATA International’s team successfully defended the client’s interests in a dispute with the Northwestern Main Directorate of the Bank of Russia

The dispute concerned administrative liability under Part 1 of Article 19.7.3 of the Code of Administrative Offences of the Russian Federation (KoAP RF) for failure to submit reports within the prescribed period.

The established case law excludes the possibility of recognizing an offence as insignificant if a ruling has previously been issued on similar grounds.
Decision:

• Justification of the absence of a real threat to the protected public relations,
• Submission of evidence of immediate compliance with the order, confirmation of correct and prompt rectification of the technical error.

The Arbitrazh Court took into account the arguments on insignificance and noted:

• The violation did not cause any adverse consequences for the state, society, or citizens,
• The client took measures to prevent similar situations in the future.

Result: the ruling imposing a fine was declared unlawful and annulled.
