Regulation for the provision of public services for registration of trademarks and service marks has been approved in Uzbekistan

The administrative regulation on the provision of the state service on registration of trademarks and service marks were approved by the Resolution of the Cabinet of Ministers of the Republic of Uzbekistan No. ПКМ-480 dated September 19, 2023 (the “Regulation”).

In accordance with the Regulation, the provision of the state service is carried out by the Ministry of Justice as an authorized body, and applications for registration of trademarks may be filed directly by applicants or through patent representatives.

To obtain this state service, it is necessary to apply through the information system of the authorized body or Unified portal of interactive public services (EPIGU), as well as through the mail. After filing the application, the applicant is obliged to pay the patent fee.

According to the Regulation, trademarks may not be registered:

  • marks containing images of state emblems, flags and state awards;
  • marks that may mislead consumers about the goods or its manufacturer;
  • marks that contradict public interests, principles of humanity and morality.

The Intellectual Property Agency shall conduct an official examination of the application within 30 days from the date of receipt.
