New Law on Economic Freedom and Amendments to the Law on Investment

New Law on Economic Freedom and Amendments to the Law on Investment

Introduction

On 3 July 2026, the State Great Khural of Mongolia adopted the Law on Economic Freedom and, in connection with its adoption, introduced amendments to the Law on Investment.

The Law on Economic Freedom establishes fundamental principles governing economic activities, including safeguarding the freedom to conduct business, protecting property rights, promoting fair competition, limiting state intervention, and ensuring a stable and transparent legal environment for businesses.

To give effect to these principles in the context of investment activities and strengthen the legal safeguards protecting investors’ rights and legitimate interests, corresponding amendments were introduced to the Law on Investment. In particular, the amendments establish new principles governing investment activities, expand the permitted forms of investment, enhance protections for investors’ property rights and assets, and introduce measures to restrict unlawful interference and unjustified inspections by government authorities. Other key features of the reform include revised conditions and periods for tax stabilisation, as well as clearer procedures governing government services provided to investors and the resolution of complaints and disputes.

This legal update outlines the principal provisions of the Law on Economic Freedom and provides an article-by-article comparison of the amendments to the Law on Investment against the previous legal framework. It also examines amendments to other relevant legislation and explains their implications for businesses and investors.
