CASE №1:

In this case, our client (plaintiff) pursued a USD 135 000 claim against a counterparty (defendant) for the non-payment of services, inclusive of the contractually agreed penalty and attorney’s fees. The claim arose from a service agreement under which the defendant had failed to fulfill their payment obligations.

During the legal proceedings, initiated under civil procedure, the defendant acknowledged the debt but expressed financial constraints, requesting to discharge the payment in installments over an extended period. Our client agreed to negotiate but proposed a shorter and more practical payment schedule to ensure timely recovery.

Following structured negotiations, the parties reached a mutual settlement agreement, which was formally executed and incorporated the revised payment timeline. The case was successfully resolved under the simplified procedure, avoiding prolonged litigation while preserving the enforceability of the agreement.

Upon initiation of the dispute resolution process, the defendant acknowledged the outstanding obligations and proposed to settle the debt through installment payments. After constructive discussions, the parties mutually agreed on a reasonable installment schedule.

A formal settlement agreement was subsequently concluded between the parties, detailing the payment terms and preserving all legal safeguards for enforcement. The case was resolved efficiently through the simplified civil procedure, avoiding unnecessary litigation and enabling both parties to move forward under clear and enforceable terms.
