Maxim Lashkevich is a Partner and Head of the Construction & Real Estate and IT Law practices at GRATA International.

With over 20 years of experience in the construction industry, Maxim has gained unique expertise in land law, construction, and real estate transactions.

His extensive experience in senior positions within state organizations responsible for real estate registration, as well as in design and engineering firms, enables him to advise companies on complex and ambiguous issues related to real estate investments, land use, construction, real estate transactions, and corporate relations regulation.

Maxim also practices in the field of IT Law, covering matters related to cryptocurrency and token circulation, privacy and personal data protection, and legal support for IT businesses.

Experience
  • Representation of investors’ interests in the acquisition of a land plot for the construction of a trade center in Vitebsk and support of construction, negotiations with citizens whose residential buildings were to be demolished for the purposes of construction;
  • Representation of investors’ interests in the conclusion of the investment agreement with the Republic of Belarus and acquisition of a land plot for the construction of a trade center in the city of Mazyr;
  • Advising and supporting the investor during the implementation of the project for the construction of a plant for the production of liquefied petroleum gases; 
  • Advising and supporting in the implementation of the investment project for the construction of three administrative buildings on Zheleznodorozhnaya street in the city of Minsk;
  • Elaboration of a concept for resolving a dispute between the developer and participants in shared construction regarding parking erected during the construction of the business center, preparing the action plan, as a result the state registration of the parking as the property of the developer was recognized by the court as invalid, the partnership of owners got the land plot, owners obtained the possibility of using the parking plot;
  • Advising on making investments in the construction of mushroom production facilities, due diligence of a Belarusian company, support for the investor’s acquisition of shares in the company, and conclusion of the SHA between the members;
  • Representation of interests of a Russian investor in the course of the acquisition of a major production base by purchasing a Belarusian legal entity with a preliminary DD and support of further reconstruction of that base;
  • Representation of investors’ interests in the acquisition of a land plot in the central part of Minsk by purchasing a Belarusian legal entity (the land user) for further implementation of a business center construction project, legal support of the construction;
  • Advising and supporting the Russian chain of catering facilities in the course of its entry to the Belarusian market: conclusion of the license agreement for transfer of the rights on intellectual property objects, etc.;
  • Legal support of a foreign investor in the implementation of a major project in the field of livestock husbandry - registration of a company, obtaining land for commercial agriculture, advice on the import of plant seeds and livestock;
  • Legal support for the activities of a developer of a large business center in the central part of Minsk, creation of a partnership of owners for the operation of the constructed facility;
  • Advising an American internet company on the use of Belarusian jurisdiction for issuing its cryptocurrency and its subsequent circulation, including the possibility of using it as a means of payment.
  • Conducting a detailed regulatory, legal, and tax analysis for a Russian company on the legal nature of cryptocurrency, ownership rules, and transaction procedures, with the development of a step-by-step guide for the legal verification of counterparties registered in the Republic of Belarus.
  • Advising automobile manufacturers on the possibility of integrating in-car footage recording modules, radar detectors, and anti-radar systems, as well as the regulations applicable to their operation.
  • Extensive experience in support of complicated cases on state registration of real estate property;
  • Extensive experience in the representation of interests of the parties in conclusion and performance of real estate property sale and purchase agreements, equity participation in construction, and use of real estate property as security for other obligations;
  • Extensive experience in support of transactions with shares of commercial organizations, registration, reorganization, and liquidation of companies;
  • Experience in drafting normative and legal acts in the sphere of state registration of real estate property, developing proposals for improvement of the legal environment on the issues of land plots allocation and land usage procedures;
  • Experience in working with technical regulatory legal acts in the field of design and construction, and preparation of proposals for improving the conditions contained therein.
