GRATA International successfully represented “Viksa Metallurgic Plant” SC, a part of OMK, in cross-border recognition of foreign arbitration resolution and enforcement proceedings against “Orkhan-N” LLC in the Republic of Azerbaijan.

The dispute arose out of a commercial contract, which was resolved by the Moscow Commercial Arbitration Court in favor of “Viksa Metallurgic Plant” SC. By decision, the Court awarded the client the amount of USD 36 693.22 in principal debt, along with legal expenses.

GRATA’s team secured the recognition of the arbitral award of the Moscoü Commercial Arbitration before the Supreme Court of Azerbaijan, which confirmed the enforceability of the decision on the territory of Azerbaijan in accordance with the 1958 New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards, to which both Russia and Azerbaijan are parties.

Following recognition, GRATA also successfully represented the client before the Enforcement Department, obtaining full recovery of the awarded amount, including payment in full of the debt and legal expenses by “Orkhan-N” LLC.

The successful implementation of this project confirms the team’s practical experience in the field of international arbitration, as well as its effective handling of recognition and enforcement procedures of foreign arbitral awards in accordance with the international obligations of the Republic of Azerbaijan.
