GRATA International Russia case: Protection of the interests of the freighter in international commercial arbitration in the case of recovery of demurrage and interest due to prolonged unloading of cargo at the port of destination

The client's contract contained conflicting provisions regarding the norms and conditions of cargo unloading.

The charterer's interests were protected by applying interpretation methods established by law and judicial practice to the contract.

As a result of the analysis, it was found that the shipowner included in the calculation a time that should not have been taken into account, while the charterer met the deadlines stipulated in the contract for unloading operations.

The arbitrators dismissed the claim, as a result of which the charterer was released from the claims and received compensation for legal support costs.
