Belarus has approved amendments to the Treaty on the Customs Code of the EAEU in terms of changes to the regulation of foreign electronic commerce
In June 2023, the EEC Council approved the Protocol on Amendments to the Treaty on the Customs Code of the Eurasian Economic Union concerning the Regulation of Foreign electronic commerce. The draft was focused on the national coordination of the participating countries. On December 18, 2023, an Edict was signed encouraging the Protocol.
Some amendments are proposed in the draft Protocol, for example:
- new terms will be added: "electronic commerce goods", "electronic commerce goods intended for sale to individuals", and "customs duty on electronic commerce goods".
- a new chapter 43-1 "Specifics of the procedure and conditions for the movement of electronic commerce goods across the customs border of the Union" will be established. It defines the procedure’s specifics and conditions for the import of e-commerce goods into the customs territory of the EAEU, their location and use, customs operations related to temporary storage, customs declaration, the release of e-commerce goods, the application of customs payments for export from the territory of the EAEU, the specifics of the customs procedure of a customs warehouse.
- a new party will be implemented – an e-commerce operator. The main function is to perform customs operations in respect of electronic commerce goods on the territory of the Member State, by whose customs authority it is included in the register of electronic commerce operators, under international treaties and acts in the sphere of customs regulation. National legislation may establish additional qualification requirements in the future.
